Gary Smith was instructed by a company in respect of alleged breaches of restrictive covenants by a former and very senior member of its sales team and allegations by the former employee of unpaid contractual commission monies.
Gary advised the client on the complexities of the covenants relating to client contact and non-competition with consideration given to potential arguments of breach of contract by the company.
After Gary’s advice the former employee entered in to further undertakings concerning the covenants. Since that time no further breaches of the covenants has occurred to the company’s knowledge.
