The client was a respected and esteemed consultant who was a pedestrian killed in a road traffic accident. Sadly the claimant was fatally injured and died after eight weeks in a coma.
A claim was successful in recovering compensation for:
- His loss of amenity
- Bereavement award for his widow
- Dependency claim for his widow based on his loss of earning
The claimant was in his 70s and continued to work full time as a consultant. Although the driver’s insurers’ solicitors argued he was beyond normal retiring age, it was successfully proven that his income was likely to have continued for a further four years. Given his contract of employment and consultancy work, this resulted in significant settlement.
