This case consisted of three claims against the company for direct race discrimination made more complicated by the fact that the employee remained employed by the business and therefore tactics had to be adjusted to ensure the ongoing employment relationship.
The employer had purchased the business from an administrator and had inherited two of the three claims, these having arisen prior to the transfer and having limited paperwork supporting its position.
As a result of Gary Smith’s advice and submissions, two of the discrimination claims were struck out at a preliminary hearing and the third was successfully defended at a full merits hearing.
