Gary Smith was instructed in this extremely complicated claim involving allegations of unfair dismissal, disability discrimination, harassment and whistleblowing arising from two separate claims to the Employment Tribunal.
The employee was claiming a five-figure sum despite earning a smaller five-figure sum per annum.
Unfortunately the company had not followed a full Acas Code compliant dismissal procedure and as a result the company was bombarded with extensive and wholly unreasonable correspondence from the employee’s advisers.
Following our efforts in submitting a robust response to the claim a settlement was eventually reached at a greatly reduced sum compared to the total value claimed by the employee.
