Zen Thompson and Jenna Brewer of our Family Team recently worked on a case in the High Court in relation to fertility law, which has been publicly reported .
The case concerned the issue of legal parenthood of two children born following fertility treatment where a mistake was made in the completion of the consent form at the time of treatment.
The court considered the relevance of the parents’ behaviour following the treatment, as well as the intentions of each parent at the time the consent form was signed.
This is a complex area of family law with specific regulations, and it can be that issues in relation to legal parenthood only arise many years after a child’s birth, when the parents separate.
