Gary Smith was instructed by the employer in a case where a former employee raised a complaint of unfair dismissal and a number of separate allegations of direct race discrimination in a claim that he valued at over a five figure sum.
The employee was a director in charge of digital marketing and acted in person adding a further layer of complication to the proceedings.
After submitting a robust response to the claim and upon our application at a preliminary hearing the Employment Tribunal struck out three of the employee’s allegations and made deposit orders on three further allegations.
As a result the employee withdrew his claim on a ‘drop hands’ basis with no settlement monies being paid to him and without the need to proceed to a full hearing.
