Birth certificates
Official translations into English of the children’s birth certificates will be required if they were born in Spain but their parents are getting divorced in the UK.
The Spanish birth certificate will refer to the use of two surnames. In Spain, two surnames are used, the father’s first surname and the mother’s first surname. Furthermore, Spanish women do not use their husbands’ surnames after getting married. Official translators will include notes to indicate this, so that the correct names are used.
In addition, an official translation into English of a Spanish birth certificate is required to apply for a British passport in the UK if the applicant was born in Spain, and either or both parents are British.
The Spanish birth certificate together with its official translation into English must be submitted to the Passport Authorities in the UK.
Marriage certificate
The official translation into English of a Spanish marriage certificate will be needed for many reasons. For example, a British couple may marry in Spain, and the wife will have to submit the official translation to the British Passport Office and banks to change her surname if she is taking her husband’s surname.
In addition, the official translation of the marriage certificate may be necessary to prove that a person married in Spain, also divorced in Spain. When a person marries and then divorces in Spain, the divorce will be recorded by the Spanish Registry Office and annotated on the existing marriage certificate. If one of the ex-spouses is going to remarry in the UK, he or she could request, from the relevant Spanish Registry, an up-to-date marriage certificate with the annotation regarding the divorce. The official translation will confirm that he or she is now divorced. In this case it may not be necessary to submit the official translation of the Spanish divorce decree.
In many aspects, the Spanish marriage certificate is similar to the English marriage certificate because it provides the personal particulars for the groom and the wife. However, the Spanish marriage certificate will also include any recorded further information related to any future change in the spouses’ civil status. Furthermore, it is important to note that Spaniards use two surnames, the first surname is the father’s first surname, and the second surname is the mother’s first surname. Besides, Spanish women do not take their husbands’ surnames after marriage.
Deed of Marriage
In Spain, people can get married before a Notary at a Notary’s office. The would-be spouses will have to attend a Notary’s Office to sign the Deed of Marriage before the Notary and two witnesses. For example, if the wife is British and wishes to take her husband’s surname, she will have to submit the Spanish documents with their official translations to the Passport Office and banks.
An official translation into English of the Spanish Deed may be needed if one of the spouses or both spouses are British, living in Spain at the time, and they have to confirm the marriage to the British Authorities.
Libro de Familia
The Libro de Familia, Spanish Family Book, is a family register usually handed over to Spanish citizens when they get married. This register which is a little book contains stamped copies of the marriage, birth of children, etc. and is issued by the Spanish Ministry of Justice.
Citizens of other nationalities may also get the Family Book when they are living and get married in Spain.
There is not an equivalent of this register in the UK.
An official translation of the Spanish Family Book into English may be needed when a Spanish family moved to the UK for work purposes or when the spouses got married in Spain but start divorce proceedings in the UK. It is also needed when applying for residency.
Official translators are expert in legal terminology. They are also very familiar with the differences between the English and Spanish legal systems and will produce accurate translations to be accepted by the British Authorities.

Traducción jurada de documentos de derecho de familia españoles
Certificado de nacimiento
Se necesitará la traducción jurada al inglés del certificado de nacimiento español de los hijos si ellos nacieron en España, pero los padres se están divorciando en el Reino Unido.
El certificado de nacimiento español hará referencia al uso de dos apellidos ya que en España se usan dos apellidos (el primer apellido del padre y el primer apellido de la madre). En el Reino Unido sólo se usa un apellido. El traductor jurado, normalmente incluye una nota para explicar que en España se usan dos apellidos y que las mujeres españolas no toman el apellido del marido después de contraer matrimonio.
Además, se necesitará la traducción jurada a inglés del certificado de nacimiento español para solicitar el pasaporte británico en el Reino Unido, si el solicitante nació en España y uno de los progenitores es británico.
Se deberá presentar a las autoridades en el Reino Unido el certificado de nacimiento español y su correspondiente traducción jurada a inglés como parte de la solicitud del pasaporte británico.
Certificado de matrimonio
La traducción jurada al inglés del acta de matrimonio española se necesitará en muchos casos. Por ejemplo, cuando una pareja británica haya contraído matrimonio en España, la esposa tendrá que presentar la traducción jurada a la oficina que emite el pasaporte en el Reino Unido o al banco para cambiar su apellido ya que en el Reino Unido es costumbre que las mujeres usen el apellido del marido después de contraer matrimonio.
Además, se podrá necesitar la traducción jurada del acta de matrimonio para acreditar que una persona que contrajo matrimonio en España se divorció después también en España. El Registro Civil en España anotará el hecho del divorcio en el acta de matrimonio existente. Si uno de los excónyuges va a volver a contraer matrimonio, por ejemplo, en el Reino Unido, podrá solicitar, del registro civil pertinente, un acta de matrimonio actualizada con la anotación relativa al divorcio. La traducción jurada demostrará que ahora él o ella están divorciados y pueden volver a casarse. En ese caso no habría que presentar una traducción jurada de la sentencia de divorcio española.
En muchos aspectos, el acta de matrimonio española es parecida al acta de matrimonio inglesa porque detalla los particulares de los contrayentes. Sin embargo, el certificado español también incluirá información futura que se haya inscrito y relativa a cualquier cambio que se haya producido con respecto al estado civil de los contrayentes. También es importante tener en cuenta que los ciudadanos británicos sólo usan un apellido. Además, las mujeres británicas normalmente adoptan el apellido de su marido, después de contraer matrimonio.
Escritura de Matrimonio
En España, se puede contraer matrimonio delante de un Notario en una Notaria. Los cónyuges tendrán que acudir a una Notaría para firmar la Escritura de Celebración de Matrimonio delante del Notario y dos testigos.
Se necesitará una traducción jurada al inglés de la escritura española si uno de los cónyuges o los dos son británicos, viven en España en el momento de contraer matrimonio, y tienen que confirmar el matrimonio a las autoridades británicas. Por ejemplo, si la esposa es británica y desear tomar el apellido del marido, como es la costumbre en el Reino Unido, tendrá que remitir los documentos españoles al organismo relevante que emite los pasaportes y a sus bancos.
Libro de Familia
El Libro de Familia es un registro familiar que normalmente se entrega a los ciudadanos españoles cuando contraen matrimonio. El libro confirma los particulares del matrimonio, nacimientos de los hijos, etc. El Ministerio de Justicia emite el Libro.
Los ciudadanos de otros países también podrán obtener el libro si residen y contraen matrimonio en España.
No existe un documento parecido al libro en el Reino Unido.
Se necesitará la traducción jurada del libro al inglés si una familia española se muda al Reino Unido por motivos laborales o si los cónyuges contrajeron matrimonio en España, pero inician los trámites de divorcio en el Reino Unido. También se necesita a la hora de solicitar la residencia.
