Descendants of Spanish nationals may be able to apply for Spanish nationality through their corresponding Spanish Consulate in the UK (the closest to their of place of residency), or directly in Spain.
The applicants will need to submit the official translations into Spanish of certain English documents such as:
- Their apostilled birth certificate to prove their relationship with the Spanish national.
- The apostilled marriage certificate of their parents.
- The apostilled naturalisation certificate of the Spanish national. Their Spanish mothers may have acquired their British nationality. Many Spanish citizens applied for British nationality when they moved to the UK many years ago. At the time it was not possible to keep their Spanish nationality, and they had to renounce their Spanish nationality to acquire British nationality.
- In certain cases, the apostilled criminal records certificate ACRO.
Spanish citizens, when they got married, were normally provided with the Libro de Familia, Spanish Family Book, a family register containing stamped copies of the marriage, birth of children, etc. and was issued by the Spanish Ministry of Justice.
There is not any document like this in the UK, therefore, several documents and their corresponding official translations are required to prove the family links.
The purpose of an official translation is to confer the translated document the same legal value as the original document by providing it with international legal validity.
Official translations do not need to be apostilled (legalised). The international legal validity of the official translations is conferred by the official translator’s certification, signature and stamps.
The documents to be apostilled (legalised) are the original documents in English. Official translators are not responsible for the legalisation of the documents.
Official Translators are expert in the terminology used in the aforesaid documents and the differences and similarities between the two legal systems involved (Spanish and English in this case), therefore they will produce accurate official translations to be accepted by the Spanish Authorities.
Traducciones juradas de los documentos para solicitar la nacionalidad española
Los descendientes de ciudadanos españoles podrán solicitar la nacionalidad española a través de su correspondiente consulado español en el Reino Unido (el más cercano a su domicilio), o directamente en España.
Los solicitantes tendrán que presentar las traducciones juradas al español de ciertos documentos en inglés, como, por ejemplo:
- Su certificado de nacimiento apostillado para demostrar la relación con el ciudadano español.
- El certificado de matrimonio apostillado de los padres.
- El certificado de naturalización apostillado del ciudadano español. Muchos ciudadanos españoles solicitaron la nacionalidad británica cuando se fueron a vivir al Reino Unido hace muchos años. Por entonces, no era posible mantener la nacionalidad española y tuvieron que renunciar a su nacionalidad española para adquirir la nacionalidad británica.
- En algunos casos, el certificado de penales apostillado, ACRO.
A los ciudadanos españoles, cuando contraían matrimonio, se les entregaba el Libro de Familia. El libro confirma los particulares del matrimonio, nacimientos de los hijos, etc.
No existe un documento parecido al libro en el Reino Unido, por lo tanto, se requieren varios documentos y sus correspondientes traducciones juradas para demostrar la relación familiar.
El objetivo de la traducción jurada es conferir al documento traducido el mismo valor legal que el documento original, dotándolo de validez legal internacional.
No es necesario apostillar (legalizar) las traducciones juradas. La validez legal internacional de las traducciones juradas es conferida por la certificación, firma y sello del traductor jurado.
Los documentos que hay que apostillar (legalizar) son los documentos originales en inglés. Los traductores jurados no son responsables de la legalización de los documentos.
Los traductores jurados son expertos en la terminología usada en los documentos indicados y las diferencias y similitudes en los dos sistemas jurídicos, que en este caso son el inglés y el español, y, por lo tanto, producirán traducciones juradas precisas que serán aceptadas por las autoridades españolas.
